Basic

In this terms of service/sale we and us means Mr. Manuel Marchiodi and his website guardyangel.com, with office in Vienna, Austria.
These terms of service/sale along with your order confirmation constitute the contract between us and you for the supply for goods.
No other terms and conditions shall apply.
The contract cannot be modified unless we agree vary it by writing or in e-mail.
Each order submitted constitutes an offer to purchase goods from us. Orders are subject to availability and acceptance by us and we may, at any time and on our sole discretion, refuse to accept your order, including but not limited to cases that: you provided us with incorrect information including insufficient or incorrect payment details, incorrect billing information, insufficient or incorrect shipping adress or fraudulent information.
The act of sale will be accomplished between you as customer and the managing director Mr. Manuel Marchiodi, Guardyangel headquartered in Vienna, Austria.
When you click on the confirm button after the process of ordering, you state to fully accept the terms of service/sale and without reserve.

The data recorded by guardyangel.com constitute the proof of the whole of the transactions made through guardyangel.com and its customers. 

All Vintage pieces offered are original pieces, all in unworn vintage new old stock conditions, unless stated differently.

Please understand that most of our items have been stored and transported for many years, so they could hold minor signs of aging.

Due to the reason that through the years acetate deformes, the glasses (especially temples) may not be perfectly symmetrical. Any optician can easily fix it with very little effort, by heating up the acetate and molding it to give the glasses a symmetrical shape again.
Even a frame that has never been out of its original package can change over time. Pressure from other frames in the box and changes in temperature and humidity can cause shape changes and may throwing the frame out of adjustment. Metal parts such as hinges can tarnish and become stiff. But in any case you are protected by our refund policy. 
We will not be held responsible if the optician breaks the frame in the process of inserting the lenses into the frame.

The data recorded by the system of payment constitute the proof of the financial transaction.

By accepting our Terms of service/sale you agree to the business conditions and consent to a lawfully binding declaration of intend to purchase the ordered product.
The colors of the products offered for sale on guardyangel.com may not correspond with the actual items, depending upon the internet browser and/or monitor used by the customer.

The glasses come without case, unless otherwise stated.

Guardyangel.com is not responsible for any inaccuracies due to a particular computer configuration or its malfunction.

Prices

All prices are in Euros and 20% VAT included, but don't include shipping costs.
Shipping costs are billed to the customer at the end of the checkout process in addition to the price of the selected item.
Any customs clearence is at customers charge.
Guardyangel.com may change the item offered for sale on its website and its pricing without advanced notice.

Warranty

The regulation issued by the EU regarding the two year defect of quality guarantee can not be sustained, since the offered merchandise consists of items of at least ten or more years old. Consequently it must be regarded as second hand and not as factory new merchandise. The warranty is therefore limited to twelve months.

All products which are not labeled with the "CE"-label are sold as collectors items. Therefore the use of this products is at the own risk of the customer.

Refund

If you are not happy with an item you recieved for any reason, you may return it and we will refund your money.
The Customer can return the product in its original state without giving reasons, within 14 days. The term begins on receipt of the product by the customer.
Any product with visible wear and tear will not be refunded. In this case the customer has to pay compensation.
We do not refund any shipping charges and any other costs (for example: custom taxes).
Revocation can be made in writing an email to: info@guardyangel.com or sending back the item. 

The product must be returned to: Manuel Marchiodi, Gartengasse 9, 2352 Gumpoldskirchen, Austria.

The parcel should be labeled as "return goods" in order to release them from the customs.

We accecpt Paypal, credit cards (Visa, Mastercard) and bank transfer.

The product remains in our property until the customer paid the entire purchase sum.

Standard shipping: 20€

We are shipping with Austrian Post AG.
We will ship your item within maximum five business days after we recieved your payment.
European and international express or overnight delivery is possible. Feel free to contact us at info@guardyangel.com, if you would like to choose these options.
Any customs clearence is at customers charge. 

Bridge: Measured between the two closest points of the lenses.
We personally measure all of our glasses. We will not be held responsible for any inaccurancies in the stated measurements.

Privacy Policy

Personal data will not be disclosed to third parties.
If the user visits the site usually no personal data will be collected or processed, since the data processing is limited to the so called "surfing data", which is data whose transmition to the site is necessary to allow the functioning of the information systems that manage the site and more generally the use of internet communications protocolls. Surfing data is data used to visit the site together with other parameters on the relevant operating system. We collect this data and other data, such as the number of visits and the times spend on the site only for statisticall purposes and in anonymous form to monitore the correct functioning of the site and to improve its functionalities.
We do not collect surfing data to associate them with other user information or to identify users.

Place of jurisdiction

The place of jurisdiction for any potential disputes concerning the contract is Vienna, Austria.

Limits of responsibility

For greater security we use SSL (Secure Socket Layer) technology, but we cannot guarantee that the site is free of viruses or damaging programms. By using the site the user takes responsibility related to its use and assumes the full responsibility for any unsuccessfull use, loss of data and/or costs required for technical repaire of the hardware and/or software in relation to the site. The user also agrees not to hold us responsible in any manner for any damage caused by using the site. 

 

Intellectual property 

The trademark Guardyangel, its Logo and its domain name are registered and exclusive property of Mr. Manuel Marchiodi.

The webiste may contain content created by third party, information obtained from public sources and/or link to external Websites or Webpages operated by third parties. We do not control or monitore such third party content and Websites and we are not responsible or liable for the accuracy, security or reliability of any third party content and Websites.
